2. Service Description
Maucommerce provides a platform that enables businesses to create and manage online stores. We offer a free forever demo for users to explore our Services and paid plans that offer additional features. Users can upgrade to a paid plan through my.maucommerce.com, or we can manually upgrade or create an account on their behalf if needed.
3. User Responsibilities
As a user of Maucommerce, you agree to comply with all applicable laws, including the laws of Mauritius. You are prohibited from using the Services to sell illegal, politically affiliated products, adult content, or any other items prohibited by Mauritian law. Any violation of these responsibilities may result in the termination of your account.
4. Subscription and Account Management
Maucommerce offers three paid subscription plans, in addition to a free forever demo. You may upgrade your account at any time through my.maucommerce.com. Billing for paid plans will be processed according to the plan you select:
- Monthly Plans: Renewal date is before the 5th of each month.
- Yearly Plans: Renewal date is at least 1 week before the end of the subscription year.
Your subscription will automatically renew unless you cancel it before the renewal date. In the event of any issues with your account, you must address them within 72 hours of receiving a warning. Failure to do so will result in the termination and banning of your account.
5. Refund and Compensation Policy
Maucommerce operates a strict no refunds policy. However, if your business is disrupted due to issues with Maucommerce or Ecwid, we may offer compensation in the form of account credits, free months of service, or a discount on your next renewal plan, at our discretion.
6. Account Termination
Your account may be terminated if you violate these Terms, particularly the prohibitions on illegal, politically affiliated, or adult content. If a violation is detected, you will receive a warning and must take corrective action within 72 hours. If no action is taken, your account will be terminated, and you will be banned from using the Services.
7. Payment Gateway Fees
If you choose to accept payments via credit cards or other payment methods on your Maucommerce store, you are responsible for paying any fees or charges levied by your payment gateway provider. These fees are not covered by Maucommerce and must be paid by you directly to the payment gateway.
8. Additional Services and Charges
Any additional work or services you require from Maucommerce that go beyond the standard Services offered may incur extra charges. These charges will be based on a quotation provided by Maucommerce and must be agreed upon before any additional work begins.
9. Responsibility for Product Images
You are responsible for ensuring that you have the legal right to use any images or media you upload or use on your Maucommerce store. This includes obtaining the necessary copyrights, licenses, or permissions (including compliance with DMCA or any special licenses). Maucommerce is not liable for any legal issues that arise from the unauthorized use of images or media on your store.
10. Third-Party Applications
If you choose to use third-party applications, including Ecwid apps, with Maucommerce, you do so at your own risk. Maucommerce is not responsible for any issues, damages, or disruptions caused by third-party apps. You are encouraged to review the terms and conditions of any third-party services you use in conjunction with Maucommerce.
11. Security and Data Protection
You are responsible for taking appropriate security measures when exporting customer data and orders from Maucommerce. Maucommerce will not be held liable for any mishandling or breaches of customer data that occur due to your actions. It is your responsibility to ensure compliance with all data protection laws applicable to your business.
12. Liability and Indemnity
Maucommerce is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Services. In the event of service disruptions, our liability is limited to providing compensation as outlined in our Refund and Compensation Policy. You agree to indemnify and hold harmless Maucommerce, its affiliates, and their respective officers, directors, and employees from any claims arising out of your use of the Services.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Mauritius. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.
14. Modifications to Terms
Maucommerce reserves the right to modify these Terms at any time. We will notify you of any significant changes via email or through our platform. Continued use of the Services after such modifications constitute your acceptance of the new Terms.
